The human right to Adequate Housing is an evolving and at the same time controversial issue in global and regional human rights systems. The book argues that there are great disparities in formulating the key aspects of the human right to adequate housing among the universal human rights system and the three main regional human rights systems. The book concludes that the African human rights system does not properly set the key aspects of the human right to adequate housing even though it adopted the three in one approach, when compared to both international human rights law and the two major regional human rights system which do not adopt the same approach.

This thesis has three objectives. First, it attempts toqualitatively describe the ASEAN cooperation in order to promote interest in ASEAN.Second, it quantitatively estimates the effect of international trade on economic developmentof the ASEAN nations. Finally, it investigates how the effect of international trade oneconomic growth varies as a result of differences in human capital, financial resources andinstitution across the ASEAN nations.To accomplish these tasks, panel dataset on the ASEAN nations from 1980 to 2010are collected and pooled OLS, fixed-effect and instrumental variable models are applied tothe dataset. Taking into account a variety of specification issues as well as endogeneity oftrade openness, the research results show that trade openness plays an extremely importantrole on economic development of these countries. In addition, the benefit from tradeopenness is greater in countries that have more educated workers, deeper financial resourcesand better quality of institution. The importance of the topic is that the regulation of reservations to human rights treaties brings lots of issues, even though on theoretical level it seems to be unproblematic. Firstly, there is a major group of states that want to become parties to the treaties that protect human rights and make reservations to fundamental provisions of them at the same time. Secondly, the state parties that make objections to the reservations have to decide if the reservation is compatible with the object and purpose of the treaty or not. The regulation that is laid down in Vienna Convention on the Law of Treaties creates difficulties for the state parties and withdrawal of reservations seems to be more problematic in reality than it is in theory. In order to find the solutions for the above mentioned issues, the author analyses whether the Vienna Convention on the Law of the Treaties regime works properly within the mechanism of making reservations to the human rights treaties, what reservations should be kept invalid and what could be the solutions for the most effective protection from the invalid reservations that address fundamental rights of human beings in the human rights law.

“Human Rights” is not an abstract or ideal concept but it is very much a pragmatic concept about those Rights, which are considered essential for the survival, dignified life and development of all human beings. In 1993, the Parliament of India passed the Protection of Human Rights Act. The main purpose of the Act was to create the National Human Rights Commission (NHRC)-a proclaimed independent governmental body statutorily charged with ensuring that every individual's Constitutional Rights are protected by the Indian state. At the time of its announcement, NHRC met with lot of skepticisms. To some it was going to be a ‘toothless tiger’, while others found it to be a mere ‘post-office’ to provide a certificate of good behavior to the government for its wrong doings rather than to ensure better protection of Human Rights. Thanks to the Committee who prepared the draft of the Commission and made every attempt to keep it (NHRC) independent of political interference. The overall pattern suggests that human rights violation incidents had declined after signing of an agreement but non-state actors were responsible for most of human rights violation acts in post-accord Nepal. Findings from this study confirms early studies that on human rights situation in Nepal. Nevertheless, this study provides more sophisticated analysis and suggests where one would expect to see more human rights violation and who would be most likely to perpetrate acts of human rights violations.

The international human rights system faces a lot of challenges with regard to the realization of the international human rights norms. The U.S.-led multilateral efforts - in the form of sanctions - to resolve the cycle of human rights violations in Sudan have so far yielded limited success partly due to Chinese support for President Bashir. After the cold war during the decades of development of democracies the role of sanctions as instruments of international relations has raised significantly. Through the evolution of the Common Foreign and Security Policy of the European Union the use of sanctions has also crystallized. Otherwise it remains always a question whether sanctions are justified? Are they effective? Is the application of sanctions the best way against human rights violation? Or sanctions are accompanied by human rights violation themselves? In my work I am looking for answers for these questions, focusing on the relation of sanctions and human rights. In my paper firstly I introduce the evolution of the Common Foreign and Security Policy of the European Union and the development of EU sanction policy. I outline the legal basis of the sanctions and present the different types of restrictive measures and their relations to the United Nations' principles. Through case studies regarding Belarus, Sudan, Burma and Zimbabwe I present the use of different sanctions in order to ensure the respect of human rights. I also analyse whether these sanctions themselves violate to a certain extent human rights causing harm for the civil population or not. Finally, I give an overview about other soft measures of the European Union concerning the promotion of human rights.
