Seminar paper from the year 2003 in the subject Law - Comparative Legal Systems, Comparative Law, grade: 75% (=With Distinction), Cardiff University (Großbritannien; Law School), course: Comparative Contract Law, language: English, abstract: The question as to whether a third party can be granted rights or protection based on a contract between two other parties to which the third party is a mere stranger is as old as the legal scholarship of contract law itself. Over centuries, quite different approaches to the issue have been evolved and embedded in different legal systems, each with its own characteristics and features. This essay intents primarily to analyse and compare the approaches of English1 and German Law to third party rights arising from bilateral contracts, particularly with regard to contracts for the benefit of a third party and the new Contracts (Rights of Third Parties) Act 1999. However, despite this main focus, some other features related to third party involvement in mutual contracts will be considered too. In the first and the second part of this essay I will describe the modus operandi of English and German law with regard to third party rights and highlight differences and similarities. The third part of this paper concerns the approach of that what is sometimes called an international restatement of contract law, namely the UNIDROIT Principles of International Commercial Contracts,2 to the rights of third parties. This is basic text which offers a comprehensive approach to the consideration of environmental protection law and practice. Essential concepts and issues in Environmental science, including global warming caused by greenhouse effect, negative and positive feedback, the Gala hypothesis, the Chaos theory, environmental economics principles of cost-benefit analysis, tradable permits, and other topics, have been explained in such detailed but straightforward manner for the law student, law lecturer, legal practitioner and even the general reader, who may otherwise feel unfamiliar with some of these scientific subjects critical to appreciating the law in the area, to comprehend quite easily. Of tremendous benefit of the legal practitioner, researchers and judges, this book also examines a lot of cases of environmental protection both in Nigeria and foreign jurisdictions, such as the United Kingdom, United States, India, the Philippines, and a host of other countries mostly within the common law tradition. The intention is to give life to the cold principles of environmental protection law by examining the cases in which environmental legal principles have been applied. It is hoped that environmental law students, law lecturers, legal practitioners and policymakers should find this book indispensible, and judges, too, in their adjudication of technical environmental matters.

Yandle examines today's most pressing environmental and natural resource management problems, including water quality, the ozone layer, acid rain, and access to groundwater contained in aquifers. He argues that common sense should dictate the simplest, least costly ways to address the problem of access to limited natural resources. Yandle challenges readers to invent methods for creating wealth by building appropriate institutions and enforcing intelligent laws. This book is essential reading for students and scholars of environmental economics, politics, and law.

Despite bringing prosperity, industrialisation generally leads to increasing levels of pollution which has a detrimental impact on the environment. In response, legislation which seeks to control or prevent such impact has become common. Similarly, climate change and energy security have become major drivers for the regulatory regimes that have emerged in the energy field. Given the global or regional scope of many environmental problems, international cooperation is often necessary to ensure such legislation is effective. The EU and the UK have contributed to the development of the environmental and energy law regimes currently in force, spanning across international, transnational and national levels. At the same time, practical responses to environmental and energy problems have largely been the focus of engineers, scientists and other technical experts. Environmental & Energy Law attempts to bridge the knowledge gap between legal developments designed to achieve environmental and/or energy-related objectives and the practical, scientific and technical considerations applicable to the same environmental problems. In particular, it attempts to convey a broad range of topical issues in environmental and energy law, from climate and energy regulation, technology innovation and transfer, to pollution control, environmental governance and enforcement. In addition the book outlines key sector specific legal regimes (including water, waste and air quality management), focusing on issues or topics that are particularly relevant to both environmental and energy lawyers, and engineering, science and technology-oriented professionals and students. In this vein, the book guides the reader on some basic practical applications of the law within scientific, engineering and other practical settings. The book will be useful to all those working or studying in the environmental or energy arena, including law students, legal professionals, engineering and science students and professionals. By adopting a multi-disciplinary approach to environmental and energy law, the book embraces all readerships and helps to address the often thorny problem of communication between scientists, engineers, lawyers and policy-makers.

Seminar paper from the year 2006 in the subject Law - Civil / Private / Trade / Anti Trust Law / Business Law, grade: A (1,0), New York University School of Law, language: English, abstract: Corporate law aims at protecting shareholders from being subject to personal liability for the risks of conducting business. The state created a corporate fiction which is a separate legal entity and distinctive from the shareholders and which offers the primary advantage of limited share-holder liability. The underlying notion is to encourage shareholders to provide capital and take on risky investments. In this way, the risk is shifted towards third parties and costs are external-ized. Overall, this investor attitude encourages economic development. Hence, limited liability can be seen as the "cornerstone of capitalism". However, as moral hazard comes into play, the externalization costs might exceed the benefits and, thus, damage third parties. In order to pro-mote justice, the presumption of limited liability must be occasionally rebutted and personal li-ability imposed on shareholders. This concept known as piercing the corporate veil will be elabo-rated on in detail in this paper. The doctrine is of crucial importance since it is the most litigated issue in corporate law. Regrettably, it is also among the most confusing areas of law. "'Pierc-ing' seems to happen freakishly. Like lightening, it is rare, severe, and unprincipled."The objective of this paper is ...

In September 2001, the East Asia Ministerial Conference on Forest Law Enforcement and Governance (FLEG) took place in Bali, Indonesia and adopted the Bali Declaration. The participating countries committed themselves to strengthen their efforts in combating illegal logging and other forest crimes. In June 2010 the Food and Agriculture Organization (FAO) published a review of FLEG progress in Asia and the Pacific, keeping the issue a priority in global environmental governance. Although the region of Southeast Asia accommodates only 5% of the world's forests, it accounts for nearly 25% of the global forest loss over the past decade, whereas illegal logging is the major cause (World Bank 2010). Therefore this region is closely watched by the international community regarding progress towards sustainable forest management (SFM). The practice of illegal logging leads to an estimated annual loss of US$ 15 billion in developing countries. Introducing Global Health: Practice, Policy, and Solutions is a contemporary overview of the major issues in global public health. The book explores how population health might be maximized with the right blend of health system, education, antipoverty, infectious disease, urban development, governance, and incentive-based policies. It covers topics critical for understanding the state of the world today, including wars for natural resources, the missing women phenomenon, and whether global aid really works. The book's case studies focus on developing economies, mixed economies, and new emerging superpowers. Thematic chapters are interwoven with running motifs, such as the health risks and benefits associated with different totalitarian, capitalist, and market socialist economies. Moving beyond statistics, the book represents a major innovation in the teaching of global health by presenting technical concepts including the incidence and prevalence of disease within the context of more accessible topics such as global poverty. This helps students contextualize otherwise challenging but critical concepts, such as the burden of infectious disease. By encouraging reflection, focusing on what works, and using activities and exercises, Introducing Global Health both teaches fundamentals of global public health and cultivates a policy perspective that is appealing and compelling for today's students.

Rembe formulated the following African demands for the translation of the concept of Common Heritage of Mankind into the envisaged New Law of the Sea. These are namely: the usage of the seabed for exclusively peaceful purposes, ensuring the rational exploitation of the resources, and the minimization of likely adverse economic effects.Following the historical developments between the 1958 Geneva Conventions and the aftermath of the 1994 Agreement Relating to the Impl...

How much further should the affluent world push its material consumption? Does relative dematerialization lead to absolute decline in demand for materials? These and many other questions are discussed and answered in Making the Modern World: Materials and Dematerialization. Over the course of time, the modern world has become dependent on unprecedented flows of materials. Now even the most efficient production processes and the highest practical rates of recycling may not be enough to result in dematerialization rates that would be high enough to negate the rising demand for materials generated by continuing population growth and rising standards of living. This book explores the costs of this dependence and the potential for substantial dematerialization of modern economies. Making the Modern World: Materials and Dematerialization considers the principal materials used throughout history, from wood and stone, through to metals, alloys, plastics and silicon, describing their extraction and production as well as their dominant applications. The evolving productivities of material extraction, processing, synthesis, finishing and distribution, and the energy costs and environmental impact of rising material consumption are examined in detail. The book concludes with an outlook for the future, discussing the prospects for dematerialization and potential constrains on materials. This interdisciplinary text provides useful perspectives for readers with backgrounds including resource economics, environmental studies, energy analysis, mineral geology, industrial organization, manufacturing and material science.

International law, sometimes called the law of nations, has evolved over the last 400 years. The three major sources of international law according to Article 38 of the Statute of the International Court of Justice are: international conventions or treaties; international customs; and the general principles of law as recognized by civilized nations. The Permanent Court of Arbitration was established by the Hague Conferences of 1899 and 1907, and the Permanent Court of International Justice was set up in 1921 and succeeded in 1946 by the International Court of Justice. Since World War II international organizations such as the UN and its related bodies have contributed to the expansion and increased scope of international law to include political and strategic affairs, economic, social, communications, and environmental matters. By the 1990s international law had shown its durability and flexibility by expanding to cover new areas of world relations, and its efficacy through the machinery of the UN.

The book While Diplomats Speak paints a broad picture of the last fifty years of a great country with today's world in the background. The author grew up in the Soviet backwaters. Without any connections or sponsors and overcoming traps set by secret services, he became a corresponding member of the Russian Academy of Sciences and a specialist on Third World economies. He worked hard in many of those economies, including Chile, Mexico, Kenya, Cameroun, India, Nepal and Thailand. At one time he was a deputy Soviet foreign minister. Obminski wrote much on world economic problems and also three books of satirical verse and prose. The author reminisces about, among others, historical figures he knew personally, including members of the all-powerful Soviet Politbureau and architects of Perestroika, and lays bare the secret springs of well-known events. The chapters "Foreign Ministry Headquarters", "United Nations Corridors" and "Heading for Collapse" reveal the underside of top-level decision-making that shaped the fate of the country. Section 2.2 of this edition was revised in December 2017 in response to recent developments. The handbook provides an overview of chambers operations and the work of the federal courts; it does not provide detailed procedures on every aspect of a law clerk’s daily tasks, nor does it review the procedures of each individual court (largely because law clerks’ duties vary from judge to judge). Law clerks should familiarize themselves with local court procedures and inquire about a local chambers manual.

Self-sufficiency of the house is practiced in many parts of the world but ignored in economic theory, just as socialist collectivization is assumed to have brought household self-sufficiency to an end. The ideals of self-sufficiency, however, continue to shape economic activity in a wide range of postsocialist settings. This volume's six comparative studies of postsocialist villages in Eastern Europe and Asia illuminate the enduring importance of the house economy, which is based not on the market but on the order of the house. These formations show that economies depend not only on the macro institutions of markets and states but also on the micro institutions of families, communities, and house economies, often in an uneasy relationship.

Enables readers to apply core principles of environmental engineering to analyze environmental systems Environmental Process Analysis takes a unique approach, applying mathematical and numerical process modeling within the context of both natural and engineered environmental systems. Readers master core principles of natural and engineering science such as chemical equilibria, reaction kinetics, ideal and non-ideal reactor theory, and mass accounting by performing practical real-world analyses. As they progress through the text, readers will have the opportunity to analyze a broad range of environmental processes and systems, including water and wastewater treatment, surface mining, agriculture, landfills, subsurface saturated and unsaturated porous media, aqueous and marine sediments, surface waters, and atmospheric moisture. The text begins with an examination of water, core definitions, and a review of important chemical principles. It then progressively builds upon this base with applications of Henry's law, acid/base equilibria, and reactions in ideal reactors. Finally, the text addresses reactions in non-ideal reactors and advanced applications of acid/base equilibria, complexation and solubility/dissolution equilibria, and oxidation/reduction equilibria. Several tools are provided to fully engage readers in mastering new concepts and then applying them in practice, including: Detailed examples that demonstrate the application of concepts and principles Problems at the end of each chapter challenging readers to apply their newfound knowledge to analyze environmental processes and systems MathCAD worksheets that provide a powerful platform for constructing process models Environmental Process Analysis serves as a bridge between introductory environmental engineering textbooks and hands-on environmental engineering practice. By learning how to mathematically and numerically model environmental processes and systems, readers will also come to better understand the underlying connections among the various models, concepts, and systems.

In 2000, the International Law Commission (ILC) decided to include the topic "[r]isks ensuing from the fragmentation of international law" into its long-term programme of work. This initiative raises some basic questions: is international law a fragmented system? If it is so, what is the problem with the fragmentation? and how can the problem be resolved? This dissertation mainly revolves around these three major issues. It assumes that today's fragmented international law is part of historical evolution or process. In contemporary times, the term 'fragmentation' is commonly used to refer to the slicing up of international law 'into regional or functional regimes that cater for special audiences with special interests and ethos'. The most notable functional regimes are international trade law, environmental law, human rights law, humanitarian law, law of the sea and so on - when there is a collision between these regimes - than the conflict of norms becomes an unavoidable consequence - because each regime seeks favorable treatment towards its own. Essay from the year 2013 in the subject Politics - International Politics - Environmental Policy, grade: 100.00, , course: EMBC - Neoliberalism and Conservation, language: English, abstract: Neoliberalist economic policy is one of the main driving forces in world governance in the 21st Century. Unfortunately, its attributes (individual property rights, unrestrained competition, deregulation, privatisation, short-term profit, risk-propensity, lack of safeguards, globalisation) seem to be completely at odds with environmental sustainability. Neoliberal policy may be the major reason for the failure of governments to form proper environmental protection guarantees for the security of future generations. This is particularly apparent in the context of climate change, where corporate and environmental interests consistently clash, and fisheries, where the commercialization of species may threaten future food security. In this essay, I ask if it is possible to reconcile neoliberalism with marine conservation, with focus on fisheries management. I begin by describing failures to protect natural environments, and the particular characteristics of the marine realm and of neoliberalism that are of relevance in the conflict between economic and environmental interests. I go on to explain the interplay between these factors, and the effect of resulting policies on environmental sustainability. I consider the role of the valuation of natural capital as a major area of debate in terms of t...

Respect for the rights of third parties in international adjudication is necessary if the ideal of a war-less world is to be realized. Hence, every affected party must be catered for in any international adjudicatory scheme. The term "intervention" in international procedure describes the mode through which a third State participates, for protection of its own interests, in an international proceeding already set in motion at the instance of two or more States2. The Statute and the Rules of the International Court of Justice make provisions for third party intervention. The institution of third party intervention serves a paramount goal. It seeks to safeguard third party rights, thereby, making third parties a part of the process of pacific settlement of international disputes. Nevertheless, the unpalatable truth is that there is nothing satisfactory about the institution of third party intervention at the International Court of Justice. There is need for reform. This book is an excellent reference material for students and practitioners of international law.
