Paul Petersen An analysis of the benefits and critique between the free trade agreements NAFTA and CETA in a historical comparison

Master's Thesis from the year 2018 in the subject Business economics - Economic Policy, grade: 1,9, Cologne Business School Köln, language: English, abstract: The following paper refers to the potential of international free trade agreements to create interconnected economic markets, which require a common trade policy of the contracting countries. The difficulty in this approach is to ensure an economic integration of both countries on the basis of bilateral treaties, despite differing cultural, social and economic attitudes. As an effect of the continuing globalization and the increased international interconnectedness, there is generally a rising number of international free trade agreements among countries with the intention to achieve economic growth and welfare that on the other hand simultaneously led to an increased amount of criticism arising from non-governmental organizations, consumer protection organizations or environmental groups. This oppositeness has received a lot of attention during the recent negotiations and implementation of the Comprehensive Economic and Trade Agreement (CETA) between the European Union and Canada. Similar to the Transatlantic Trade and Investment Partnership (TTIP), which is a foreseen free trade agreement between the European Union and the United States that has been temporarily suspended due to huge protests, both agreements have in common that they bear more criticism that than any other free trade agreement ever before. This is...

Master's Thesis from the year 2012 in the subject Politics - International Politics - Environmental Policy, grade: 1,3, University of Southampton, language: English, abstract: Following years of incredible economic development in China, the country today is facing severe, environmental problems. This has been widely acknowledged by Chinese leaders as well as by international scholars. This work presents a detailed analysis of the foreign environmental policy of the People's Republic of China (PRC) for the period from 1972 to the present day. In recent decades, the country's behaviour changed from having an initial policy of refusal to having a more cooperative position within international negotiations, combined with voluntary agreements to reduce greenhouse gas emissions. While the central government undertook its first steps towards a green, foreign environmental policy, scholars mainly analysed this changing behaviour from a political or economic standpoint. This work, however, no longer uses 'traditional' viewpoints to explain the changing behaviour, but focuses on social structures that act as drivers for China's cooperative behaviour within global environmental governance structures. Therefore, three hypotheses are developed from a constructivist framework. According to these hypotheses, China's foreign environmental policy is driven by three incentives: its new identity as a 'green' developing country; the emergence and cascade of th...

Handbook of Environmental Economics: Volume 3: Economywide and International Environmental Issues

Many of the frontiers of environmental economics research are at the interface of large-scale and long-term environmental change with national and global economic systems. This is also where some of the most of challenging environmental policy issues occur. Volume 3 of the Handbook of Environmental Economics provides a synthesis of the latest theory on economywide and international environmental issues and a critical review of models for analyzing those issues. It begins with chapters on the fundamental relationships that connect environmental resources to economic growth and long-run social welfare. The following chapters consider how environmental policy differs in a general-equiIibrium setting from a partial-equilibrium setting and in a distorted economy from a perfect economy. The volume closes with chapters on environmental issues that cross or transcend national borders, such as trade and the environment, biodiversity conservation, acid rain, ozone depletion, and global climate change. The volume provides a useful reference for not only natural resource and environmental economists but also international economists, development economists, and macroeconomists. Master's Thesis from the year 2015 in the subject Politics - International Politics - Topic: International Organisations, grade: 2,0, University of Frankfurt (Main), course: Internationale Studien, language: English, abstract: The Hashemite Kingdom of Jordan is characterized by a high vulnerability regarding climate change-induced effects and environmental developments. As governmental bodies seem to fail the task of preserving the human habitat, environmental NGOs are already filling a gap. Likewise, the cooperation with international organizations is also an important factor for the work of national NGOs. This raises the question, if and how the government of Jordan and international organization create obstacles for environmental NGOs. After conducting an analysis inspired by grounded theory, including a two step coding process of primary data, it becomes obvious that environmental NGOs in Jordan are facing several challenges. Firstly, they are adopting governmental tasks. Secondly, NGOs are challenged by a high level of competition. Thirdly, they are confronted with difficulties created by international organizations and the government. Furthermore, those actors are in need of gaining financial security and to improve international cooperation within the Levant to diminish climate change-induced effects, negative environmental developments, and to contribute to a sustainable environment.

Legal Aspects of the EU Association Agreements with Georgia, Moldova and Ukraine in the Context of the EU Eastern Partnership Initiative

The present publication is probably the first comparative analysis of the new Association Agreements between the European Union, its Member States and Georgia, Moldova and Ukraine from a legal perspective. It mainly includes contributions by young scholars from Georgia, Moldova and Ukraine, which were prepared in a research project at the University of Kiel in 2014/2015.The three Association Agreements share many similarities, e. g. in the DCFTA parts of the agreements, but there are also significant differences, e. g. in the size of the agreements and in many details. Some provisions are also related to WTO rules, others to EU law. Parallels may also be seen with other EU trade agreements, such as CETA and TTIP. For a correct interpretation and application of the three Association Agreements a comparative view is helpful in order to avoid divergences in interpretation, but also in order to understand the existing specifics of each Agreement.Although the book is written from a legal perspective it is hoped to be useful for any reader interested in international trade and in political cooperation between the EU and its Eastern neighbours.

How can as much biodiversity as possible be preserved on the Earth? The author claims that the answer to this question lies in the realm of economics. Therefore, in this book he sets out to understand the role that economics plays in international environmental policy-making. He considers both the economic factors and the non-economic factors which are at play in such policy-making, and then considers whether both economic and environmental objectives can be jointly achieved in order to preserve biodiversity.

In addition, it is focused on the driving forces and levels of international and country-specific environmental policies. The roots of environmental policy are pointed out. In this context, the different levels of environmental regulations are identified therewith deducing implications for the compliance-behaviour of firms. This paper also explicates the environmental implications of different economic theories. It is exemplified how different stakeholders might influence the strategic orientation of enterprises towards environmental performance and the various environmental strategies on firm-level are explicated. It is especially focused on different approaches being developed in order to test the empirical evidence predictions of the "pollution haven hypothesis". Therefore four studies are reviewed and commented on.

Seminar paper from the year 2006 in the subject Politics - International Politics - Environmental Policy, grade: 2,4, University of Potsdam (Lehrstuhl für intl. Organisationen), course: International regimes: Theory, empirics and policy, 39 entries in the bibliography, language: English, abstract: For a long time oceans were seen as vast and restless. In recent years, however, this view has changed since the pollution of the sea became an ever serious problem. Fairly cleaned liquids as well as various waste-pieces have massive implications on the maritime life. In addition, intentionally discharged as well as accidentally released oil-products propose a huge challenge to the global community. Therefore the essay elaborates on this ecological issue with focus on oil-tankers as well as it lists up international actions taken against it. These are regime-induced (MARPOL 73/78) modifications at the ships itself such as load on top, segregated and protectively located ballast tanks, crude-oil-washing and double-hulls. The hypothesis of the paper is that the international measures taken have been adequate in general and changed the discharging habits of the industry lastingly. The agreements also seem to have made it possible to have the oceans nowadays less polluted than it assumably would have been without them. Therefore, apart from minor potential future corrections, the international regime for protecting the oceans against the pollution from oil-tankers was rather successful.

Europeanisation, as the term is used in this paper, is concerned with the consequences of European integration for the member and applicant states and politics within them.It is found that especially through the accession process it was easy to 'export' EU rules and principles - firstly, because the pressure to adopt EU legislation was high and secondly, because local elites were ready to take EU templates. After an introduction to the topic the second chapter presents an overview over EU environmental policy, whereas the third chapter focuses on Lithuanian environmental policy and the adaptations through the EU accession process. Robert Perryman Can we reconcile neoliberalism and marine conservation. Conflict between economic and environmental interests

Essay from the year 2013 in the subject Politics - International Politics - Environmental Policy, grade: 100.00, , course: EMBC - Neoliberalism and Conservation, language: English, abstract: Neoliberalist economic policy is one of the main driving forces in world governance in the 21st Century. Unfortunately, its attributes (individual property rights, unrestrained competition, deregulation, privatisation, short-term profit, risk-propensity, lack of safeguards, globalisation) seem to be completely at odds with environmental sustainability. Neoliberal policy may be the major reason for the failure of governments to form proper environmental protection guarantees for the security of future generations. This is particularly apparent in the context of climate change, where corporate and environmental interests consistently clash, and fisheries, where the commercialization of species may threaten future food security. In this essay, I ask if it is possible to reconcile neoliberalism with marine conservation, with focus on fisheries management. I begin by describing failures to protect natural environments, and the particular characteristics of the marine realm and of neoliberalism that are of relevance in the conflict between economic and environmental interests. I go on to explain the interplay between these factors, and the effect of resulting policies on environmental sustainability. I consider the role of the valuation of natural capital as a major area of debate in terms of t...

Georges Ugeux International Finance Regulation. The Quest for Financial Stability

As the global market expands, the need for international regulation becomes urgent Since World War II, financial crises have been the result of macroeconomic instability until the fatidic week end of September 15 2008, when Lehman Brothers filed for bankruptcy. The financial system had become the source of its own instability through a combination of greed, lousy underwriting, fake ratings and regulatory negligence. From that date, governments tried to put together a new regulatory framework that would avoid using taxpayer money for bailout of banks. In an uncoordinated effort, they produced a series of vertical regulations that are disconnected from one another. That will not be sufficient to stop finance from being instable and the need for international and horizontal regulation is urgent. This challenge is the focus of Georges Ugeux’s book. International Finance Regulation: The Quest for Financial Stability focuses on the inspirations behind regulation, and examines the risks and consequences of fragmentation on a global scale. Author Georges Ugeux has four decades of experience in the legal and economic aspects of international business operations. He created and run the New York Stock Exchange’sinternational group in charge of developing the NYSE’s reach to non-US companies, including relationships with regulators and governments. Ugeux teaches European Banking and Finance of the Columbia University School of Law. Ugeux is uniquely positioned to provide recommendations and suggestions from the perspective of a top global authority. In the book, he explores international regulation with topics such as: • Laws, regulations, and risks of overregulation • Transformation of the U.S. market and creation of the Eurozone • Development of a global framework and stability of the banking system • In-depth examination of Basel III, the Dodd-Frank Act, the European Banking Union, and the Volcker Rule The book also contains case studies from real-world scenarios like Lehman, CDS, Greece, the London Whale, and Libor to illustrate the concepts presented. Finance consistently operates within an increasingly global paradigm, and an overarching regulation scheme is becoming more and more necessary for sustainable growth. International Finance Regulation: The Quest for Financial Stability presents an argument for collaboration toward a comprehensive global regulation strategy.

Research Paper (undergraduate) from the year 2007 in the subject Law - Miscellaneous, grade: pass, University of the West of England, Bristol (School of Law), course: Masters of Law paper, 104 entries in the bibliography, language: English, abstract: States and international organisations are formal actors in drawing up international environmental agreements. As mentioned, nongovernmental organisations also has a key role to play. From the time of the adoption of the United Nations Charter in 1945, which provided for accreditation of NGOs (Art. 71), the NGO world experienced exponential growth. Some scholars believe that a critical mass has been reached making NGOs the new "fifth state" on the field of global governance (Fitzduff et.al., 2004:2) . NGOs have, in many places, become significant political actors, and this heterogeneous group has made its presence felt at the local, national, and international levels. However, the growing numbers of NGOs do not entail a similar transition of their official status under the UN system. As provided in the UN Charter (Art. 4), only states can be members of the organisation. Hence, only voting states have formal powers to determine the outcome of international treaty negotiations. NGOs are subject to rules established by states, if any, for their limited participation in negotiation meetings. Although NGOs are cannot vote during international negotiations, they have devised ways to have an effect on the results of the process....

Diploma Thesis from the year 2011 in the subject Politics - International Politics - Environmental Policy, grade: 1,0, University of Potsdam (Lehrstuhl für Internationale Politik), language: English, abstract: The problem of deforestation and forest degradation is currently highly prominent on the international agenda. In September 2001, the East Asia Ministerial Conference on Forest Law Enforcement and Governance (FLEG) took place in Bali, Indonesia and adopted the Bali Declaration. The participating countries committed themselves to strengthen their efforts in combating illegal logging and other forest crimes. In June 2010 the Food and Agriculture Organization (FAO) published a review of FLEG progress in Asia and the Pacific, keeping the issue a priority in global environmental governance. Although the region of Southeast Asia accommodates only 5% of the world's forests, it accounts for nearly 25% of the global forest loss over the past decade, whereas illegal logging is the major cause (World Bank 2010). Therefore this region is closely watched by the international community regarding progress towards sustainable forest management (SFM). The practice of illegal logging leads to an estimated annual loss of US$ 15 billion in developing countries. The Association of Southeast Asian Nations (ASEAN) recognizes the importance of FLEG as a way to hinder these huge economic losses as well as the environmental and social consequences. Master's Thesis from the year 2010 in the subject Politics - International Politics - Topic: Public International Law and Human Rights, grade: A plus, Jawaharlal Nehru University , course: Master of Philosophy (M.Phil.), language: English, abstract: From the beginning of the twenty-first century the international community started addressing the issue of fragmentation of international law. In 2000, the International Law Commission (ILC) decided to include the topic "[r]isks ensuing from the fragmentation of international law" into its long-term programme of work. This initiative raises some basic questions: is international law a fragmented system? If it is so, what is the problem with the fragmentation? and how can the problem be resolved? This dissertation mainly revolves around these three major issues. It assumes that today's fragmented international law is part of historical evolution or process. In contemporary times, the term 'fragmentation' is commonly used to refer to the slicing up of international law 'into regional or functional regimes that cater for special audiences with special interests and ethos'. The most notable functional regimes are international trade law, environmental law, human rights law, humanitarian law, law of the sea and so on - when there is a collision between these regimes - than the conflict of norms becomes an unavoidable consequence - because each regime seeks favorable treatment towards its own. The absence ...

Todd N Tucker Judge Knot. Politics and Development in International Investment Law

In recent decades, international legal constraints have shifted far beyond the national border. International lenders' structural adjustment programs require states to slash budgets, privatize public enterprises and cut pensions. Trade agreements have shifted from locking in low tariffs to forbidding policies that today's rich countries used to climb up the developmental ladder. This suite of neoliberal policies has been labeled the "golden straitjacket" for their supposed promise of unlocking economic growth. [NP] 'Judge Knot' explores a corollary to the straitjacket: investor-state dispute settlement (ISDS), where foreign investors can sue host states out of national courts before transnational tribunals over government regulation. Since 1990, corporations have launched hundreds of cases against states over environmental conservation, financial stabilization and public service provision. In an era of Donald Trump, Brexit, Bernie Sanders, and Jeremy Corbyn, criticism of this system has grown enormously. Yet meaningful reform has been difficult. Even though neoliberal economics is on the wane, its legal underpinnings remain attractive to the corporations that demand investment law and the arbitrators who supply it.Building off of an unprecedented set of interviews with the arbitrators who actually decide the cases, the interdisciplinary 'Judge Knot' brings together the best of political science, law and development economics scholarship to offe...

Marcus Wagner Consistency and Credibility.

Consistency and Credibility? identifies in its first part the extent of correlation between actual environmental performance, the use of physical environmental performance indicators and corporate environmental reporting in the paper and electricity industries in Germany and the UK. The results suggest environmental performance is mainly country-related, possibly due to differences in environmental legislation. This implies that any assessment of the relationship between environmental and economic performance of firms needs to be based on actual environmental performance data and cannot take reporting quality or information about the intensity of use of specific tools, such as environmental performance indicators as a proxy variable. The second part of the book therefore analyses the relationship between environmental and economic performance. Based on the results, the book's second part concludes that for firms in environmentally-intensive industries it is difficult to create a positive link between their environmental and economic performance, and that market settings as well as strategy considerations both can have an effect, but situational aspects determine which of these dominates.Consistency and Credibility? provides useful information for practitioners as well as deeper insights for academics about the link of environmental reporting and environmental performance measurement and how this interacts with economic success. It thus reveals valuable strategic insights ...

International law, sometimes called the law of nations, has evolved over the last 400 years. The three major sources of international law according to Article 38 of the Statute of the International Court of Justice are: international conventions or treaties; international customs; and the general principles of law as recognized by civilized nations. The Permanent Court of Arbitration was established by the Hague Conferences of 1899 and 1907, and the Permanent Court of International Justice was set up in 1921 and succeeded in 1946 by the International Court of Justice. Since World War II international organizations such as the UN and its related bodies have contributed to the expansion and increased scope of international law to include political and strategic affairs, economic, social, communications, and environmental matters. By the 1990s international law had shown its durability and flexibility by expanding to cover new areas of world relations, and its efficacy through the machinery of the UN.

Scientific Study from the year 2008 in the subject Environmental Sciences, grade: B, , 69 entries in the bibliography, language: English, abstract: Health, environment and poverty are closely interrelated and inseparable, particularly in developing countries. WHO estimates that environmental factors are the root cause of 25% of the total burden of disease worldwide and account for about 35% in sub-Saharan Africa (SSA). Effective environmental management is the key to avoiding a quarter of all preventable illnesses which are directly caused by environmental factors. In the Bibiani-Bekwai and Sefwi Wiawso Districts of the Western Region of Ghana, the environment has been altered by complex human induced factors, which have negatively impacted on the health of the population. This paper seeks to establish the major causes of environmental and human health degradation and whether there is a direct link between environmental degradation and human health in Bibiani-Bekwai and the Sefwi Wiawso Districts in the Western Region of Ghana. Four complementary approaches were used during the investigation: extensive literature review, consultations with key informants, the administration of questionnaires, and stakeholder consultations. The data was analyzed using SPSS to establish the linkages between environmental deterioration and human health in the two districts. The results clearly suggest that environmental degradation seriously affects human health in the two districts. 80% of the ...

Despite bringing prosperity, industrialisation generally leads to increasing levels of pollution which has a detrimental impact on the environment. In response, legislation which seeks to control or prevent such impact has become common. Similarly, climate change and energy security have become major drivers for the regulatory regimes that have emerged in the energy field. Given the global or regional scope of many environmental problems, international cooperation is often necessary to ensure such legislation is effective. The EU and the UK have contributed to the development of the environmental and energy law regimes currently in force, spanning across international, transnational and national levels. At the same time, practical responses to environmental and energy problems have largely been the focus of engineers, scientists and other technical experts. Environmental & Energy Law attempts to bridge the knowledge gap between legal developments designed to achieve environmental and/or energy-related objectives and the practical, scientific and technical considerations applicable to the same environmental problems. In particular, it attempts to convey a broad range of topical issues in environmental and energy law, from climate and energy regulation, technology innovation and transfer, to pollution control, environmental governance and enforcement. In addition the book outlines key sector specific legal regimes (including water, waste and air quality management), focusing on issues or topics that are particularly relevant to both environmental and energy lawyers, and engineering, science and technology-oriented professionals and students. In this vein, the book guides the reader on some basic practical applications of the law within scientific, engineering and other practical settings. The book will be useful to all those working or studying in the environmental or energy arena, including law students, legal professionals, engineering and science students and professionals. By adopting a multi-disciplinary approach to environmental and energy law, the book embraces all readerships and helps to address the often thorny problem of communication between scientists, engineers, lawyers and policy-makers.

Also including research about benefits, rewards and incentives that motivate companies to go green and which industry is putting in the most initiative to become eco-friendly and as conclusion we made some recommendations for the future. In our report, we try to explain that the challenge of a sustainable society is to achieve a competitive and eco-efficient economy, combining increased productivity with less consumption of natural resources. It is all about preventing the over-exploitation of environmental resources, the underutilization of labour resources, and integrating the economy with environmental sustainability criteria. Furthermore our report is going to analyze businesses' green initiatives and the reasoning for them doing so. The key question we try to answer is, how big of an impact are these initiatives actually having on the environment? To answer this question we analyzed articles and graphs related to environmental sustainability, governmental strategies and the impact of green businesses in order to suggest strategies to our businesses, such as tax incentives, trade agreements or export subventions on environmental friendly products. It was fundamental to make some secondar...

The end of the post-war economic boom was marked by the recognition of the environmental problem with the oil crises of the 1970s and, in 1972, the first major UN conference devoted to the human environment. Successive international meetings have resulted in a context where technical change, innovation and industry have assumed a central place in the creation of a new model of society. Against this consensus, the author demonstrates from economic analysis and wide-ranging examples that the environmental innovation doctrine and ecodesign methods remain fragile and can lead to paradoxical results.

The end of the Cold War enormously transformed the politico-strategic and economic milieu of the world politics. The disintegration of the Soviet Union changed the contours of international as well as regional power configurations. The world power structure became unipolar and globalization of the international political economy gathered pace. These shifting trends in turn had a great effect on the bilateral and multilateral relations of a number of states. Realignments and readjustments, at both regional and international level, took place. Driven by these changed global trends, India and China recognized the need to cooperate in the long-term interest of global and regional peace and stability as well as for their own economic prosperity.

Master's Thesis from the year 2011 in the subject Economics - Other, grade: 1,0, University of Manchester (School of Environment and Development), course: International Development, language: English, abstract: In face of scarce resources and growing population, sustainability became the term used to consider the needs of future generations in the decision making process referring projects. The World Bank, as one of the major players in the field of development research and practice, aggregates information from different areas in the project appraisal document (PAD) in order to allow for sustainability. One of the approaches used to measure environmental impacts of a project is economic valuation of environmental goods and services. The results of this approach flow into the cost benefit analysis, which is part of the economic analysis. Although substantial critique has been expressed over the last decades, environmental valuation and costbenefit analysis are considered sensible tools in the context of decision making over project funding. This is especially the case because of tremendous development of these techniques over the last decades. This study shows that the World Bank, as one of the leading institutions in the world, treats this topic from two different perspectives. First, there is the theoretical side. Here the World Bank sets out ideal procedures, under their rules and guidelines, and publishes papers and reports with respect to further development of underly...

Essential concepts and issues in Environmental science, including global warming caused by greenhouse effect, negative and positive feedback, the Gala hypothesis, the Chaos theory, environmental economics principles of cost-benefit analysis, tradable permits, and other topics, have been explained in such detailed but straightforward manner for the law student, law lecturer, legal practitioner and even the general reader, who may otherwise feel unfamiliar with some of these scientific subjects critical to appreciating the law in the area, to comprehend quite easily. Of tremendous benefit of the legal practitioner, researchers and judges, this book also examines a lot of cases of environmental protection both in Nigeria and foreign jurisdictions, such as the United Kingdom, United States, India, the Philippines, and a host of other countries mostly within the common law tradition. The intention is to give life to the cold principles of environmental protection law by examining the cases in which environmental legal principles have been applied. It is hoped that environmental law students, law lecturers, legal practitioners and policymakers should find this book indispensible, and judges, too, in their adjudication of technical environmental matters.

This book presents correct-by-design control techniques for switching systems, using different methods of stability analysis. Switching systems are increasingly used in the electronics and mechanical industries; in power electronics and the automotive industry, for example. This is due to their flexibility and simplicity in accurately controlling industrial mechanisms. By adopting appropriate control rules, we can steer a switching system to a region centered at a desired equilibrium point, while avoiding “unsafe” regions of parameter saturation. The authors explain various correct-by-design methods for control synthesis, using different methods of stability and invariance analysis. They also provide several applications of these methods to industrial examples of power electronics. Contents 1. Control Theory: Basic Concepts. 2. Sampled Switched Systems. 3. Safety Controllers. 4. Stability Controllers. 5. Application to Multilevel Converters. 6. Other Issues: Reachability, Sensitivity, Robustness and Nonlinearity. About the Authors Laurent Fribourg is head of the LSV (Laboratoire Spécification et Vérification) and Scientific Coordinator of the Institut Farman, Institut Fédératif de Recherche CNRS, which brings together the expertise of five laboratories from ENS Cachan, in France, in the fields of modeling, simulation and validation of complex systems.
